Licensees of KnowledgeShare and their end-users (i.e. staff and registered members of the Licensee's Library and Knowledge Service) are bound by the terms of the licence between the licensee and Brighton and Sussex University Hospitals NHS Trust.
All registered users and guest users of the KnowledgeShare web site (http://www.knowledgeshare.nhs.uk) should abide by the Terms of Use provided on this page (together with the documents referred to on it). By using KnowledgeShare you confirm that you accept these Terms of Use and agree to be bound by them.
If you do not agree to these Terms of Use, you must not use KnowledgeShare. Unauthorised use of the KnowledgeShare website may give rise to a claim for damages and / or be a criminal offence.
The term "you" refers to the registered users or guest users of KnowledgeShare. "LKS" is an abbreviation referring to the NHS library and knowledge service you are registered with on KnowledgeShare.
Responsibility for KnowledgeShare content
Information about registered users is added to KnowledgeShare and updated by users themselves or by their NHS library and knowledge service. By recording information on KnowledgeShare, or by authorising your LKS to do so, you acknowledge that it will be stored in accordance with the Data Protection Act (1998) on KnowledgeShare and other library management systems used by your LKS.
The information you provide will be available to staff members at participating NHS library and knowledge service teams by default. Information may also be made available to other registered users of KnowledgeShare according to the permission settings that you have provided. It is your responsibility to ensure that these are set according to your wishes. Responsibility for the accuracy of information lies with you or with your LKS according to who has provided the most recent update.
The health care evidence found on KnowledgeShare has been selected, categorised and summarised by staff at registered NHS library and knowledge services. Every effort has been made to ensure that the information provided is accurate, up-to-date, and complete. However, Brighton and Sussex University Hospitals NHS Trust makes no representations, warranties or guarantees, whether express or implied, that the content on KnowledgeShare is accurate, complete or up-to-date or as to the suitability of the information found for any particular purpose. It is your responsibility to determine the accuracy, validity and interpretation of evidence provided via KnowledgeShare. No responsibility can be accepted by Brighton and Sussex University Hospitals NHS Trust (or by any LKS affiliated with KnowledgeShare) for any action taken on the basis of this information and we expressly exclude liability for any inaccuracies or errors to the fullest extent permitted by law.
All links from KnowledgeShare are provided for information only. A link does not imply endorsement of that site and KnowledgeShare does not accept responsibility for the information displayed there.
Intellectual property rights
Brighton and Sussex University Hospitals NHS Trust owns all intellectual property rights in KnowledgeShare, excluding any bibliographic details or extracts of publications uploaded to the site. Those publications are protected by copyright laws and treaties around the world. All such rights are reserved.
Evidence searches sourced via KnowledgeShare may be saved or printed but must not be modified in any way and may be used in your own work or study provided that the authorship of the LKS responsible for the work is acknowledged.
You must not use KnowledgeShare or its content for commercial purposes. If you print off, copy or download any part of KnowledgeShare in breach of these Terms of Use, your right to use KnowledgeShare will cease immediately and you must, if asked, return or destroy any copies of the materials you have made.
All registered and unregistered trade marks, logos, titles, brand and product names ("the Trade Marks") which are featured on KnowledgeShare are owned by Brighton and Sussex University Hospitals NHS Trusts, unless otherwise stated. All trademarks reproduced in KnowledgeShare, which are not the property of Brighton and Sussex University Hospitals NHS Trust are acknowledged on the website.
You must not offer or distribute any products or services under or by reference to the Trade Marks, or otherwise reproduce any of the Trade Marks without express written consent
Accessing KnowledgeShare
Eligible users can access KnowledgeShare using their NHS OpenAthens password. OpenAthens usernames and passwords must be kept confidential, secure and only used according to all relevant instructions. Any organisation or user who believes that an OpenAthens username or password has become known by any unauthorised person, or is being used in an unauthorised way, must inform Eduserv immediately.
You must not attempt to violate or circumvent any security measures put in place by Eduserv or KnowledgeShare, nor make any unauthorised attempt to decrypt any protected material.
Access to KnowledgeShare may be disabled at any time if, in the opinion of Brighton and Sussex University Hospitals NHS Trust, you have failed to comply with any of the provisions of these Terms of Use.
KnowledgeShare will occasionally be unavailable due to system failures or planned maintenance. Brighton and Sussex University Hospitals NHS Trust will not be liable if for any reason the KnowledgeShare site is unavailable at any time or for any period. From time to time, Brighton and Sussex University Hospitals NHS Trust may restrict access to some parts of the site, or the entire site, to registered users.
You are responsible for making all arrangements necessary for you to have access to KnowledgeShare.
Acceptable use
You may only use KnowledgeShare for lawful purposes. You may not use, and shall take all reasonable steps to ensure that no other person uses, KnowledgeShare in a way that does not comply with the terms of any laws applicable to you or that is in any way unlawful.
KnowledgeShare must not be used to store, access, transmit, distribute, upload, download or knowingly receive objectionable material or to carry out objectionable activities. Objectionable means unlawful, false, misleading, offensive, pornographic, obscene, derogatory, discriminatory, racist, inflammatory, defamatory, malicious, threatening or causing nuisance or anxiety; or likely to expose KnowledgeShare to claims, liability, prosecution or disrepute; or actionable by any third party.
Any information you add to KnowledgeShare may be removed if, in the opinion of Brighton and Sussex University Hospitals NHS Trust, it does not comply with these standards.
The views expressed by other users of KnowledgeShare do not represent the views or values of Brighton and Sussex University Hospitals NHS Trust.
Viruses
We do not guarantee that KnowledgeShare will be secure or free from bugs or viruses.
You are responsible for configuring your information technology, computer programmes and platform in order to access KnowledgeShare. You should use your own virus protection software.
You must not misuse KnowledgeShare by knowingly introducing viruses, Trojans, worms, logic bombs or other material which is malicious or technologically harmful. You must not attempt to gain unauthorised access to KnowledgeShare, the server on which KnowledgeShare is stored or any server, computer or database connected to KnowledgeShare. You must not attack KnowledgeShare via a denial-of-service attack or a distributed denial-of service attack. By breaching this provision, you would commit a criminal offence under the Computer Misuse Act 1990 act/or any other law that supersedes such Act. Brighton and Sussex University Hospitals will report any such breach to the relevant law enforcement authorities and we will co-operate with those authorities by disclosing your identity to them. In the event of such a breach, your right to use KnowledgeShare will cease immediately.
Linking to KnowledgeShare
You may insert a simple link to KnowledgeShare from other websites provided that:
- the website on which the link appears contains no unlawful, obscene, or offensive content and does not contain any links to such content;
- the website on which the link appears is not likely to cause anxiety, loss, harm or personal injury to its readers; and
- the link in no way has a negative impact on the reputation of KnowledgeShare or Brighton and Sussex University Hospitals NHS Trust.
Brighton and Sussex University Hospitals NHS Trust reserves the right to terminate any links to KnowledgeShare at any time without notice and at their sole and absolute discretion.
Changes to these terms
These Terms of Use may be revised at any time through amendments to this page. Please check this page from time to time to take notice of any changes, as they are binding on you.
Liability
Nothing in these Terms of Use shall or shall be deemed to limit Brighton and Sussex University Hospitals NHS Trust's liability to you for any personal injury or death caused by its negligence or for any fraud it perpetrates.
Subject to the above paragraphs you acknowledge that in respect of your use and access of KnowledgeShare we shall not be liable to you in contract, tort (including negligence) or otherwise for:
- any damage or loss arising from the consequences of viruses received by you via KnowledgeShare;
- any failure to provide KnowledgeShare in accordance with these Terms of Use;
Any economic losses (including loss of profits), any indirect or consequential losses, loss of data, goodwill or reputation, or for any wasted expense including but not limited to losses caused by viruses, and any other liability Brighton and Sussex University Hospitals NHS Trust may have to you whether in contract, tort (including negligence) or otherwise for any loss or damage suffered by you in relation to KnowledgeShare (including any information contained on it) is limited to £500.
In any event Brighton and Sussex University Hospitals NHS Trust will not be liable for any failure to perform its obligations under these Terms of Use if it is prevented from doing so by an event beyond its reasonable control.
Jurisdiction
The laws of England shall apply exclusively to these Terms of Use and to all matters relating to use of KnowledgeShare. Any cause of action arising under these Terms of Use shall be subject to the exclusive jurisdiction of the courts of England and Wales.
